Effectiveness of Legal Responses
•International Covenant on Civil and Political Rights (ICCPR)
The effectiveness of this legal response/treaty is that it provides a structured and satisfying guideline in relation to the practices of Civil and Political Rights. This legal response states that all peoples have the right to self-determination. By virtue of right they freely determine their political status and freely peruse their economic, social and cultural development. All peoples may freely dispose of their natural wealth and resources without prejudice to any obligations arising out of international economic-co-operation based upon the principle of mutual benefit and international law. This legal response places a reliable authority over asylum seekers and their rights involved with Civil and Political Rights.
•Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT)
The effectiveness of this legal response/treaty is very important in relation to asylum seekers as they are subject to torture, cruel, inhuman and degrading treatment. This treaty clearly states that each state party shall take effective legislative, administrative, judicial or other measures to prevent acts of torture in any territory under its jurisdiction. There are no exceptional circumstances whatsoever, whether a state of war, international political instability, may be invoked as a justification of torture. This legal response is almost a barrier/protector for asylum seekers as it creates key procedures which must not be broken. The treaty is a beneficial factor for placing protection and security over asylum seekers.
Effectiveness of Non-Legal Responses
•Amnesty International
The effectiveness of this non-legal response is that Amnesty International works to ensure that asylum seekers and refugees affected are treated humanely. They offer insight to the government, influencing them to commit adequate resources to an effective, human-rights based regional framework that addresses the reasons for irregular migration. This campaign is extremely effective in relation to asylum seekers as it is profound to commit adequate dedication for the benefit of asylum seekers. Amnesty is a community campaign that extends a helping hand to asylum seekers, treating them like family and helping them to be there best without discrimination.
•Refugee Council of Australia
The effectiveness of this non-legal response is that the Refugee Council of Australia offers endless support to asylum seekers and refugees. The aim of the council is to treat all asylum seekers and refugees as humanely as possible, how any and all humans should be treated anyway. RCOA promotes the adoption of flexible, humane and practical policies towards refugees and asylum seekers in Australia and internationally through conducting research, advocacy, policy analysis and community education. The effectiveness of this non-legal response is that it provides an accurate hand for refugees and and asylum seekers to fall back on in times of need.
